CBI finally arrests Commissioner of Customs, CHA; detects flats in Mumbai & Patna

By TIOL News Service

MUMBAI, MAR 09, 2013: THE CBI has finally arrested the Nhava Sheva Commissioner (Exports) and a private person in a bribery case of Rs.19 Lakhs.

A case was registered against the Commissioner of Customs, (1987 Batch of IRS/Customs), JNCH, Mumbai and a Private person (Custom House Agent), on a complaint of Rajkot (Gujarat) based Complainant. It was alleged in the complaint that the Commissioner of Customs and the Private person demanded bribe from the complainant for releasing his container. Later on, the public servant directed the complainant to hand over the bribe money to private person.

CBI laid a trap and the private person was caught while demanding & accepting a bribe of Rs.19 Lakh from the Complainant on behalf of public servant. The Commissioner was also arrested.

Searches were conducted at the residential & official premises of both accused. During searches of residential premises of public servant, documents pertaining to investment made in real estate/flats in Mumbai as well as in Patna has been recovered.

Both the accused persons were produced today before the Special Court of CBI, Mumbai and remanded to Judicial Custody upto 21.03.2013.

Sub: finally arrests

the two words 'finally arrests' indicates the harassment undergone by the complainant, and it is not at all surprising that such arrest was made. In fact, if CBI gains the confidence of the public at large who would be next complainants, then they would be flooded with such complaints. In such a world, it is quite satisfying that the CBI is able to reach out to such levels for arrests.

Sub: corruption in customs

corruption in customs is so rampant and the CHA has to sacrifice for the same. If anything adverse happens, cutoms get hold of CHA first and not the officers who took bribe directly from the importers/exporters. Poor CHA has no escape. If any favouritsm is done by customs to importer/exporter, the concerned officer should be held responsible and liable to penal action and not the CHA. It requires a lot of daring to file a complainst against commissioner and the person must be congratulated to having taken risk.
