Cus - Reasons for 883 days delay in filing appeal not impressive but in interest of justice condonation allowed on payment of cost: CESTAT

MUMBAI, AUG 06, 2016: AGAINST an order passed by the Commissioner of Customs (General), Mumbai the appellant has filed an appeal before the CESTAT.

However, there was a delay of 883 days in filing the appeal and, therefore, an application for condonation of delay was filed.

The ground given for the delay is - the applicant was suffering from "major depressive disorder and anxiety symptoms" and was under the treatment of the same. A medical certificate was also produced.

The Bench observed -

"2. …, though we are not impressed with the reasons given in the application for delay of 883 days, but in the interest of justice, we allow the condonation of delay of delay subject to deposit of cost of Rs. 10,000/- within four weeks. Compliance to be reported on 16/08/2016."

The application was allowed.
