SC directs Govt not Under Secretary, only JS & above rank officials to file affidavits

NEW DELHI, JAN 11, 2017: IN an interesting development the Apex Court today flayed the practice of Union of India deputing Under Secretary-level officers to file affidavit before the highest court of the land.

A Bench headed by the CJI directed the Ministry of Law that all affidavits are to be filed before the Supreme Court by an officer not less than the rank of Joint Secretary.

Such an observation was made by the Court on failure of the Govt to file responses against a PIL on monitoring of NGOs and other voluntary bodies.

While making these observations the Bench noted that by deputing Under Secretary, the Govt has belittled the dignity of the court. Therefore, the Bench is of the view that all affidavits should be filed by JS and above level officers.

The Dignity of Court is maintained by high standards of judgements delivered by the Judges and not by the person who is signing an affidavit. This showing of Superiority complex is not good for the judges.
