Departmental Adjudication is pathologically mediocre - CESTAT President


Lack of Competent Candidates for Judicial Members

The present Rules permit a person who has been a member of Indian Legal Service for ten years to be appointed as a Judicial Member of CESTAT. However, it does not permit a Law Graduate with ten years of experience in the industry (say in a Public Limited Company with a turnover not below INR 500 Crore) of handling taxation or legal work and drawing a salary within the band prescribed for PB-4 to even apply for the job.

Therefore, one can not say that "may be it is the lure of the private enterprise that dissuades people - competent honest people to come to public service".

It is the mindset in the Government that a private person is most likely to be dishonest and is viewed with suspicion, whereas Government Servants are honest and are to be trusted.
