shailesh bhai what a speed with such tremendous research and analysis.

really this central board of exercise and customised defaults is required to know the terms like audit and verification.

i have been pointing out this very often that verification itself is not an audit. rather the term audit involves many steps or processes and verification is one of them.

rule which is already struck down by Delhi high court talks about verification only and not audit.

audit is a comprehensive activity of checking and correcting the things which being asubstative provision , needs to be made part of any law only through enactment by defining the same in sectionand not via any rule.

in other words the job of ac or dc cannot be done by inspectors no.

yesterdays circular is not been able to understand and explain also the followings
1.how departmental instruction for internal audit will get the statutory backing merely by section 94(2)k in absence of any specific provision regarding audit by department unlike 72 A .
2.what is the status of legality of this amendment of 05.12.2014 when the rule in which amendment is made itself is struck down by the honourable high court the decision is well accepted by the board in both the circulars dated. 09.10 and 10.12.14.
3.IF THE CIRCULAR OF YESTERDAY IS ACCEPTED THEN IS BOARD CLEARLY SAYING THAT TILL 06.08.14 OR 09.12.14 ALL AUDITS DONE BY ITS PEOPLE ARE ILLEGAL, UNLAWFUL ETC SINCE IT HAS OPENLY ACCEPTED THE FINDING OF DELHI HIGH COURT AND THE FACT THAT STATUTORY BACKING IS NOW GAINED AFTER 6.08.2014
