All said and done, the position in the field is really aghast. In a hurried exercise to issue max no. of SCNs before the assent to Finance Act,2005 the field offices were working on overtime basis.There are instances where the SCNs have been issued based on the TDS details collected from CBDT alleging non registration, suppression evasion etc.even to those units who were regd,paying tax filing returns etc.The urgent need is to have a policy of another REVIEW CELL which woud review the SCNs on priority .There were days in the dept,when any court matter would go to Commissioner's table on the dtae of receipt,take instructions to defend etc.Now only for the routine Bill payments,the file may reach.The involvement of the large number of senior level officers would augur well rather than any preaching High Court judgments are just ignored within their own jurisdiction by the Commissioner in the adjn orders.Only a contempt petn may help the poor victim,but als he is not party to the original case.
